By registering and creating a MyUO Account, you may access various travel related services (“Service”) that are offered by HK Express Airways Limited (“HK Express”, “we”, “our” or “us”) such as booking, check-in and seat reservation services. By registering a MyUO Account account, completing the online registration process or using our Service, you are agreeing to these Terms and Conditions. If you do not agree, please do not register and do not use our Service.
Only individuals aged 18 or above is eligible for registration and registration is subject to acceptance at our sole discretion. You may only hold one MyUO Account at any one time. You are responsible for ensuring that all information you provide to us is complete, accurate, and for informing us of any changes to the information you have provided. You may access and update your account settings and information in your MyUO Account Profile.
1.2 You must not use or submit any information about any third parties for registration of a MyUO Account.
2.1 You agree to keep your MyUO Account details safe and will not share them with others. If you become aware of or suspect that there is any unauthorised use of your account or any other breach of security, you must change your password and notify us immediately.
3.1 We provide an identity authentication function (Biometric Authentication) for you to access your MyUO Account and related services using biometric credentials, including but not limited to fingerprint, facial recognition , or such other biometric identifiers as may be prescribed by us from time to time (Biometric Credentials). To use Biometric Authentication, you must enable the biometric identity sensor module on your device and complete all activation and verification steps as specified by us from time to time.
3.2 By enabling or using Biometric Authentication, you agree that Biometric Authentication will access the Biometric Credentials stored in your device which have been successfully registered for Biometric Authentication. We do not collect your Biometric Credentials. You hereby expressly consent to our access and use of these Biometric Credentials solely for the purpose of verifying your identity prior to providing you with access to Biometric Authentication and Service.
3.3 Once you have successfully enabled Biometric Authentication in your device, you may use your Biometric Credentials registered with your device in lieu of your email address or mobile number and password to authenticate your identity to access and operate your MyUO Account maintained with us.
3.4 Biometric Authentication may only be available for devices supporting biometric authentication as prescribed by us from time to time. Biometric Authentication may not work if the device contains applications not compatible with Biometric Authentication.
3.5 You acknowledge and agree that:
a) You must be a member of the HK Express mobile app (“App”) to use Biometric Authentication.
b) Biometric Authentication uses the Biometric Credentials that you have registered and stored on your device. You must ensure that only your Biometric Credentials are stored on your device. You must not register or allow any other person’s Biometric Credentials on your device for use with Biometric Authentication. If any other person’s Biometric Credentials are stored on your device, you are deemed to have authorised such person to login to your MyUO Account and you will be fully responsible for all instructions made through such authentication.
c) You must not use Biometric Authentication if you (i) have identical siblings, or (ii) are an adolescence where your facial features may be developing rapidly.
d) You must not take any action to disable any function provided by, and/or agreeing to any settings of your device that would otherwise compromise the security of the use of your Biometric Credentials for authentication purposes, including but not limited to disabling “attention-aware” for facial recognition.
e) You are responsible for the security of your device and Biometric Credentials. You must not enable Biometric Authentication on a device that has been modified outside the manufacturer’s supported or warranted configurations. This includes but is not limited to devices that have been "jail-broken" or "rooted". A jail broken or rooted device means one that has been freed from the limitations imposed on it by the designated mobile service provider and the phone or device manufacturer without their approval. Access to your MyUO Account on a jail broken or rooted device may compromise security and lead to fraudulent or unauthorised transactions. Using Biometric Authentication on a “jail-broken” or “rooted” device to access your MyUO Account is entirely at your own risk and we will not be liable for any losses or damages or any other direct or indirect consequences suffered or incurred by you as a result.
f) Each time the App detecting the use of the Biometric Credentials registered on your device on which you have enabled Biometric Authentication to access and operate your MyUO Account, you are deemed to have (i) accessed and/or (ii) operated your MyUO Account in lieu of your email address or mobile number and password and/or (iii) instructed us to perform such actions (as the case may be).
g) You must re-activate Biometric Authentication and agree to these Terms and Conditions again: (i) for each new device that you use; and (ii) each time that you reinstall the App or delete the local credentials data on your device.
3.6 All instructions received by us with your identity verified through Biometric Authentication shall be binding on you. You are liable for all such instructions in accordance with these Terms and Conditions.
3.7 You will be liable for all losses (including but not limited to losses arising from any unauthorised accesses) if you have allowed any third party to use your device, or failed to comply with your obligations or any security measures under these Terms and Conditions, the security information and/or other relevant documents as provided by us from time to time. You agree to indemnify us and our officers and employees against any liability (including tax or levy), loss or reasonable expense arising from instructions of your MyUO Account or, if we have acted reasonably, the provision of a service to you. You also agree to be liable for all losses if you have acted fraudulently or with negligence, or allowed any third party to use your MyUO Account, or failed to comply with these Terms and Conditions.
3.8 You may deactivate Biometric Authentication for your MyUO Account. Once deactivated, you may continue to access your MyUO Account by using your email address or mobile number and password.
3.9 If you suspect that your Biometric Credentials or device security has been compromised, you must deactivate Biometric Authentication for your MyUO Account, change your device security settings, and notify us immediately. We may require you to change the relevant passwords and/or Biometric Credentials registered in your device, to cease and/or re- activate the use of Biometric Authentication.
3.10 We reserve the right to suspend, terminate, restrict, vary or modify access to Biometric Authentication for your MyUO Account at our sole discretion, without giving prior notice to you (whether in whole or in part)).
3.1 You may only access and use our Service in accordance with these Terms and Conditions, to view the availability of our Service for your personal and non-commercial purposes, to conduct lawful and authorised transactions with us, and for no other purpose.
3.2 You must not access or use (or allow access or use of) our Service in any unauthorised or illegal manner. This includes but is not limited to: any false, fraudulent or unauthorised account/registration; obtaining or any attempt to obtain unauthorised access to any of our networks or accounts or to information about other users; and any interference with or disruption to our Service.
3.3 Without prejudice to our other rights at law or otherwise, we reserve the right to terminate or suspend your MyUO Account without reference to you and/or deny you access to our Service by giving you at least 14 days prior notice, unless in the case of emergencies where we may terminate or suspend your MyUO Account or our Services immediately without prior notice.
5.1 If you choose to link your MyUO Account with other accounts, such as the Cathay Membership Account provided by Asia Miles Limited (“Third Party Account”), you will be deemed to have accepted and agreed to be bound by these Terms and Conditions:-
(a) You must be the holder of the Third Party Account you designate to be linked to your MyUO Account, and we are not obliged to verify that both the MyUO Account and the Third Party Account to be linked belong to you.
(b) You agree to provide us with the membership number, name, e-mail address and other relevant information of your Third Party Account so as to enable or disable the authorisation for account linking, unlinking and/or use of our Services including without limitation the redemption of any products or services under your Third Party Account. In this regard, you also agree and authorise us to share the information provided by you to us with the service provider of your Third Party Account and their agents, such as Cathay Pacific Airways Limited and Asia Miles Limited.
(c) You shall, at our request from time to time, sign or submit to us such documents and information and perform such acts in relation to authorisation for your Third Party Account, and enter into relevant agreements as may be required from time to time by the service provider of your Third Party Account.
(d) You understand and agree that, after your MyUO Account is linked to the Third Party Account, the service provider of your Third Party Account may instruct us at any time to execute instructions, such as the use of our Services including without limitation the redemption of any products or services under your Third Party Account. You authorise us to, without notice to you or verification with you, execute such instructions by and to transfer such information as specified in the instructions to, the service provider of your Third Party Account, and the instructions received by us from the service provider of your Third Party Account shall be deemed as what you have authorised or approved to give. Any instruction that we reasonably believe is given by the service provider of your Third Party Account will be valid and binding on you, whether or not it is in fact authorised. We need not verify the identity or authority of the person giving an instruction or the authenticity of an instruction, but we may from time to time at our discretion require evidence of identity or authority. You agree to indemnify us and our officers and employees against any liability (including tax or levy), loss or reasonable expense arising from instructions by the service provider of your Third Party Account or, if we have acted reasonably, the provision of a service to you. You also agree to be liable for all losses if you have acted fraudulently or with negligence, or allowed any third party to use your MyUO Account or Third Party Account, or failed to comply with these Terms and Conditions.
(e) You shall notify us as soon as possible if, after linking, there is any change to your Third Party Account or any information/document provided to us in relation to the authorisations thereto. If you wish to terminate the authorisation for linking with your Third Party Account, you may do the unlinking on your own in your MyUO Account to terminate the linking between your MyUO Account and your Third Party Account or may Contact Us for assistance.
6.1 We do not collect your Biometric Credentials. You consent to the authentication process and our accessing and using the information obtained via the biometric identity sensor in your device. Please refer to your device manufacturer’s privacy policy for information on how your Biometric Credentials are managed and secured.
6.2 These Terms and Conditions include our Terms of Use and our Privacy Policy which explains how we collect, store and handle any personal information you supply to us when you use our websites or mobile applications, including the Use of Cookies on our websites and mobile applications. 7.1 Separate conditions apply to airline carriage, competitions or any other promotion which we may run from time to time. In particular, the carriage of passengers and baggage by HK Express is subject to the conditions of carriage. View our Conditions of Carriage.
8.1 All information and materials relating to the Service are provided "as is" without warranty (whether express or implied) or representation of any kind. In particular, no warranty or representation regarding non-infringement of any proprietary rights, security, accuracy, fitness for a purpose or free from computer viruses is given in connection with such information and materials.
8.2 Subject to claims available under applicable consumer protection laws, we will not be liable to you or to anyone else (in negligence, tort, breach of contract, or otherwise) for any loss or damage (including direct or indirect loss, or special or consequential loss) howsoever caused arising out of or in connection with:
(a) the access or use of (or inability to access or use) your MyUO Account and/or our Service;
(c) any act or omission by us in relation to your MyUO Account or any linked Third Party Account including any failure to execute or error in executing instructions given by the service provider of your Third Party Account and their agents to us;
(d) any error, malfunctioning, interruption, suspension or failure of any software, equipment system or Biometric Authentication of HK Express;
(e) the breach in the security of your computer, mobile or other device, or the access to or use of any information held on or through your computer, mobile or other device by unauthorised third parties; and/or
(f) disruptions, defects, technical errors or other harmful elements in respect of our Service.
8.3 We are not liable for any loss caused by a third party (including the use or malfunction of Biometric Authentication or the service provider of your Third Party Account or the agent or related company thereof), government, market disruption or any event beyond our control. We are not liable to recover a payment which you have made to a third party, or to resolve a dispute between you and any third party.
8.4 The above exclusions and limitations apply to the fullest extent permitted by law.
9.1 We may make changes to all or any part of our Service from time to time and reserve the right to amend these Terms and Conditions by posting the amended terms and conditions on our websites and mobile applications. By continuing to access or use our Service, you confirm that you agree to the modified terms and conditions.
10.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. You consent to the exclusive jurisdiction of the courts of HKSAR in connection with any legal action that may arise in relation to your use of our websites, mobile applications and/or these Terms and Conditions, and we reserve the right to bring proceedings against you for breach of these Terms and Conditions in your country of residence or any other relevant country.
10.2 These Terms and Conditions are written in English language and may be translated into other languages. In the event of any inconsistency between the English version and the translated version of this notice, the English version shall prevail.
11.2 Benefits are subject to such terms and conditions as HK Express may apply from time to time in these Member Benefits Terms and Conditions, the MyUO Account Terms and Conditions, the HK Express website at www.hkexpress.com (“Website”) or the official App, the relevant advertisement, Member communication and/or notices or signage displayed.
11.3 Benefits may be subject to eligibility, capacity, availability and/or other limitations, and access may be subject to validity periods, block-out dates and/or other restrictions. Benefits are not for sale, are non-transferable, non-refundable, non-exchangeable either in whole or in part, for cash or otherwise. Unless otherwise expressly stated by HK Express, benefits may not be used in conjunction with any other discount, promo code, voucher or promotion. Unutilised benefits will be forfeited without notice or compensation.
11.4 Members may be required to present valid proof of membership and such personal identification as required by HK Express, to enjoy the benefits available to Members.
11.5 Except for benefits expressly stated as provided by HK Express, HK Express is not the supplier of the products and/or services provided by third parties (“Third Party Offers”), which provision and use may be subject to terms and conditions of such third parties. HK Express is not responsible for products and/or services provided by third parties, and gives no representation or warranty as to the Third Party Offers. To the maximum extent permitted by applicable law, HK Express shall not be liable for any loss, cost, expense, charge, taxes, damage, claim, demand, proceeding, action, obligation or liability (including without limitation, any injury, damage, loss or expense of any nature) suffered by the Member or any other person resulting from or in connection with any Third Party Offers.
11.6 HK Express reserves the right in its sole discretion to determine and change these Members Benefits Terms and Conditions at any time without notice.
11.7 In the event of any dispute, HK Express’s decision shall be final and conclusive. In case of any discrepancy between the English version and any translated version of these Members Benefits Terms and Conditions, the English version shall prevail.
11.8 Member Benefits
(a) Member Pricing Discount
(i) The Member pricing discount benefit is available to Members from 18 August 2022 to 18 August 2023, except as otherwise stated by HK Express.
(ii) Member’s pricing discount is only valid for the booking of eligible flight reservations made through the Website and the App.
(iii) Member’s pricing discount is not valid for the booking of reservations made through any other channels, including but not limited to HK Express official WeChat mini app, third-party websites and cannot be used together with any other discounts, promo codes, promotions, or vouchers.
(iv) To enjoy the Member’s pricing discount, Customers must sign up as MyUO Members and sign in using the relevant accounts before booking flight reservations. If any bookings of reservations are made without first signing in as MyUO Member, the member pricing discount will not apply.
(v) Once the Member has signed in to the relevant account, the Member pricing discount will automatically be applied to the booking of eligible flight reservations made through the Website or the App, and final fares will be displayed on the payment page.
(vi) Member’s pricing discount can be applied to each leg of an eligible flight reservation in a booking.
